{"id":2288,"date":"2017-05-17T18:28:40","date_gmt":"2017-05-17T18:28:40","guid":{"rendered":"https:\/\/bpslawtest.com\/?p=2288"},"modified":"2018-05-15T18:03:08","modified_gmt":"2018-05-15T18:03:08","slug":"the-new-york-law-journal-quotes-partner-chris-palermo-regarding-proposed-changes-to-commercial-division-rules-regarding-alternative-dispute-resolution","status":"publish","type":"post","link":"https:\/\/bpslaw.com\/staging-site\/the-new-york-law-journal-quotes-partner-chris-palermo-regarding-proposed-changes-to-commercial-division-rules-regarding-alternative-dispute-resolution\/","title":{"rendered":"The New York Law Journal Quotes Partner Chris Palermo Regarding Proposed Changes to Commercial Division Rules Regarding Alternative Dispute Resolution"},"content":{"rendered":"<p>Litigation Partner Christopher Palermo was recently quoted in<span>\u00a0<\/span><a href=\"http:\/\/www.newyorklawjournal.com\/id=1202784401107\/Rule-Would-Require-Certification-That-Parties-Were-Informed-of-ADR?slreturn=20170401142142\" target=\"_blank\"><em><span>The New York Law Journal<\/span><\/em><\/a><span>\u00a0<\/span>in an article, \u201cRule Would Require Certification That Parties Were Informed of ADR,\u201d appearing in the April 25, 2017 edition.<\/p>\n<p>Mr. Palermo is a member of the Commercial Division Advisory Council and was the primary drafter of a proposal by the Advisory Council to amend the Commercial Division rules to require attorneys to certify to the court that they have spoken with their clients about the availability of alternative dispute resolution mechanisms in cases pending in New York\u2019s Commercial Division.<\/p>\n<p>Mr. Palermo predicted that the business community would \u201cstrongly support\u201d the proposed amendment. \u00a0Similar procedures are in place in some federal courts.\u00a0 The proposed rule change would also require parties to disclose to the court whether the client is willing to pursue mediation at some point in the litigation.<\/p>\n<p>Mr. Palermo noted that businesses and in-house counsel \u201cwant mediation, and they want mediation early on in the case.\u201d<\/p>\n<p>This proposal is the latest of numerous recommendations by the Advisory Council to respond to the needs of the business community and to ensure that the New York Commercial Division remains one of the leading venues in the country for efficient resolution of complex commercial disputes.\u00a0 Since the Advisory Council was established in 2013, more than two dozen of its proposals have been approved for use in the Commercial Division.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Litigation Partner Christopher Palermo was recently quoted in\u00a0The New York Law Journal\u00a0in an article, \u201cRule Would Require Certification That Parties Were Informed of ADR,\u201d appearing in the April 25, 2017 edition.
